In separate actions commenced by Frank L. Colton against C. Starkweather & Son, Inc., and also three of its officers or employees, Colton sought to recover damages from each defendant for injuries which he sustained upon falling from an upper porch of his residence upon leaning against a porch railing which the defendants employer had contracted with plaintiff to repair. Colton alleged in his complaint that defendants were negligent in repairing the railing in such an insufficient manner that upon his leaning against it, it broke and gave way and caused him to fall to the ground and sustain said injuries. Each defendant demurred to the complaint on the ground that it did not state facts sufficient to constitute a cause of action. The demurrers were overruled by the court and from orders to that effect each defendant appealed.
