Frederick, a taxpayer of Columbia County, for declaratory relief against the Board of Trustees of the Wisconsin Retirement Fund seeking an adjudication of the constitutionality of Chapter 459 of the Laws of 1961. Permission was granted to commence this suit, and the complaint was demurred to on the grounds the plaintiffs had no capacity to sue and it does not state a cause of action.
